Mediation is a process whereby a neutral third party (the mediator) assists the parties to resolve their differences by agreement.
The mediator does not act as the lawyer for either party and cannot give legal advice to either party. The mediator’s role is to facilitate so that the parties can reach a mutually agreeable settlement.
Very often parties to a dispute choose to do what is known as a lawyer assisted mediation. The advantage of this route is that the mediator and lawyers and parties are all present during the negotiation, either in the same room or by shuttle negotiation (separate rooms). With everyone, including the legal advisors, present at the same time, it is likely that the case can be fully resolved in one day. In more complex cases possibly an additional day will be needed. This is a very effective dispute resolution procedure.
